1. Acceptance of Terms

By accessing or using LotWize (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a homeowners association (“HOA”), you represent that you have the authority to bind that HOA to these terms.

2. Description of Service

LotWize provides AI-powered HOA management tools including document intelligence, resident communication, violation tracking, financial management, and payment processing. Features vary by subscription plan.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

Some features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time through your account settings or by contacting support.

For hybrid plans, homeowners may be charged a convenience fee on payment transactions. This fee is disclosed at the time of payment.

5. Data Ownership and Privacy

Your HOA retains full ownership of all data uploaded to the Service, including governing documents, resident information, financial records, and communications. LotWize acts solely as a data processor and storage provider.

We will not sell, rent, or share your data with third parties for marketing purposes. See our Privacy Policy for complete details on how we handle your information.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload viruses, malware, or other harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service to harass, abuse, or discriminate against residents
• Interfere with the proper functioning of the Service

7. AI-Generated Content

LotWize uses artificial intelligence to generate suggestions, draft communications, and analyze documents. AI-generated content is provided as a convenience and should be reviewed by a human before being relied upon for legal or financial decisions. LotWize is not responsible for errors or omissions in AI-generated content.

8. Limitation of Liability

LotWize shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, you may request an export of your data within 30 days.

10. Governing Law

These terms shall be governed by the laws of the State of Oklahoma, without regard to conflict of law principles.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
